1. Agreement to Terms

By accessing or using the Portal mobile application ("App") operated by Portal Tech, Inc. ("Portal," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

We may modify these Terms at any time. Your continued use of the App after changes constitutes acceptance of the updated Terms.

2. Eligibility

To use Portal, you must:

• Be at least 13 years old
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the App under applicable laws
• Not have been previously banned from Portal

If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms.

3. Your Account

You are responsible for:

• Providing accurate account information
• Maintaining the security of your account credentials
• All activity that occurs under your account
• Notifying us immediately of any unauthorized access

You may not share your account, create multiple accounts, or transfer your account to another person.

4. Content Guidelines

4.1 Your Content

You retain ownership of content you create and post on Portal. By posting content, you grant us a non-exclusive, royalty-free, worldwide license to use, display, and distribute your content in connection with the App.

4.2 Content Expiration

All videos posted on Portal expire and are automatically deleted after 48 hours. This is a fundamental feature of the platform. Once content expires, it cannot be recovered.

• Is illegal or promotes illegal activities
• Contains nudity, sexual content, or sexually suggestive material involving minors
• Promotes violence, terrorism, or self-harm
• Harasses, bullies, or threatens other users
• Contains hate speech or discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics
• Infringes on intellectual property rights (copyrights, trademarks)
• Contains personal information of others without consent
• Is spam, scams, or misleading content
• Is AI-generated or fake content misrepresented as real
• Impersonates another person or entity
• Promotes dangerous activities or challenges
• Contains malware or malicious code

4.3 AI Content Policy

Portal is for real humans sharing real moments. AI-generated content, deepfakes, and synthetic media are prohibited. This includes:

• AI-generated videos or images
• Deepfake content
• Voice cloning or synthetic audio
• AI avatars or virtual influencers

5. Location Features

Portal uses your location to provide location-based features including:

• Showing content from your city and surrounding areas
• City, state, and national leaderboards
• College portal verification

By using these features, you consent to the collection and use of location data as described in our Privacy Policy.

6. Leaderboards & Rankings

Portal features competitive leaderboards. Rankings are determined by our algorithms based on engagement metrics. We reserve the right to:

• Modify ranking algorithms at any time
• Remove users who manipulate rankings through fake engagement
• Adjust rankings to prevent gaming or abuse

Attempting to artificially inflate engagement (fake likes, fake followers, engagement pods) is prohibited and may result in account termination.

7. Reporting & Moderation

You can report content or users that violate these Terms using the in-app reporting feature. We review reports and may:

• Remove violating content
• Issue warnings to users
• Temporarily or permanently suspend accounts
• Report illegal activity to law enforcement

We aim to review reports promptly but cannot guarantee specific response times.

8. Intellectual Property

The Portal app, including its design, features, code, and branding, is owned by Portal Tech, Inc. You may not:

• Copy, modify, or distribute our app or content
• Reverse engineer or decompile the app
• Use our trademarks without permission
• Create derivative works based on our app

9. Third-Party Services

The App may contain links to third-party websites or services. We are not responsible for the content or practices of third parties. Use of third-party services is at your own risk.

10. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT:

• The App will be uninterrupted or error-free
• Content will be accurate or reliable
• Any specific results will be achieved

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PORTAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE APP.

Our total liability for any claims arising from these Terms or your use of the App shall not exceed $100 USD.

12. Indemnification

You agree to indemnify and hold harmless Portal, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the App
• Your content
• Your violation of these Terms
• Your violation of any third-party rights

13. Termination

We may suspend or terminate your account at any time for any reason, including violation of these Terms. Upon termination:

• Your right to use the App ceases immediately
• Your content may be deleted
• You remain liable for any prior violations

You may delete your account at any time through the App settings.

14. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the American Arbitration Association rules. You waive any right to participate in class action lawsuits.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
